Sales Terms & Conditions
Summit Funnel & Web Design Services
These Terms & Conditions ("Agreement") govern the working relationship between D-Site Design ("Designer," "Contractor," "We," or "Our") and Client ("You" or "Your").
By engaging our services, you agree to be bound by the following terms.
1. Scope of Work
D-Site Design will provide services as mutually agreed in the signed proposal, invoice, or project outline. Services may include:
Summit Funnel Design & Production
- Summit Landing Page
- VIP Upsell Page
- Thank You Page
- Speaker/Expert Page(s)
- Replay Page(s)
Technical & Automation Services
- CRM integration and automation
- Scheduling of before-, during-, and after-summit email sequences
- Integration of forms, tags, automations, pipelines, etc.
Strategy & Collaboration
- Collaboration with Client's coach (Katie) to ensure strategic alignment
- Regular updates and project communication
Additional Optional Services
(Offered at special pricing for Katie's clients)
- Full post-event sales funnel
- Full branded website design
Any services not listed in the agreed-upon scope are considered out of scope and may require a separate quote and agreement.
2. Client Responsibilities
Client agrees to:
- Provide all content (copy, images, videos, brand assets, speaker details, etc.) in a timely manner.
- Ensure all content is legally owned, licensed, or authorized for use.
- Provide access to required platforms (CRM, hosting, website, calendar tools, etc.).
- Respond to feedback requests, questions, and approvals within 3 business days unless otherwise arranged.
- Follow the timeline and communication guidelines to prevent delays.
Failure to provide required materials may result in project delays or rescheduling.
3. Timeline & Delivery
- Timelines are estimates and depend on Client responsiveness.
- D-Site Design is not responsible for delays caused by missing content, late approvals, platform issues, or third parties.
- If Client requests expedited work, rush fees may apply.
4. Revisions
Unless otherwise stated in the proposal:
- Each page or deliverable includes up to 2 rounds of revisions.
- During the promo period: D-Site Design will make requested revisions to help increase activity.
Payment Terms
- Payment is required upfront unless mutually agreed otherwise.
- Payment plans (if offered) must be paid on schedule to avoid project pause.
Refund Policy
Because all work requires time investment, scheduling, and strategy:
- All payments are non-refundable.
- If the Client pauses or cancels the project, no refunds will be issued.
- If Client becomes unresponsive for more than 14 days, the project may be considered abandoned. Restart fees may apply.
6. Communication
- Communication will take place via email, Zoom, messaging tools, or project management platforms.
- Standard communication hours are Monday–Friday unless agreed otherwise, except during the promo period.
- Emergency or weekend work may incur additional fees.
7. Intellectual Property
Upon final payment:
- Client receives rights to the final designs and deliverables created specifically for their project.
- D-Site Design retains ownership of all design concepts, drafts, structures, code snippets, wireframes, and processes not included in the final deliverables.
- Designer may display completed work in portfolios, case studies, and marketing materials.
8. Platform Access & Security
Client agrees to:
- Provide correct login information for platforms involved in the project.
- Ensure platforms are in working condition (e.g., hosting, domain, CRM).
- Understand that D-Site Design is not responsible for third-party outages or platform errors.
9. Liability & Limitations
D-Site Design is not liable for:
- Results, sales, conversions, or revenue generated by the summit or funnels
- Technical issues caused by third-party tools (CRM, email platforms, hosting providers, etc.)
- Loss, damage, or delays caused by Client or any third party
- Errors resulting from incomplete or incorrect information provided by Client
Client holds D-Site Design harmless against any claims arising from the use of provided materials or instructions.
10. Project Completion & Launch
- Launch dates must be scheduled in advance.
- Designer is not responsible for last-minute additions or changes unless agreed in writing.
- Once a project is marked complete, any further updates will be billed separately.
11. Confidentiality
Both parties agree to maintain confidentiality of all proprietary information, logins, and sensitive business details.
12. Termination
Either party may terminate the agreement with written notice.
Client understands that:
- No refunds will be issued for completed or in-progress work.
- Any remaining fees or balances must be paid before files or access are transferred.
13. Acceptance of Terms
By submitting payment, signing the agreement, or approving the project, Client agrees to these Terms & Conditions in full.
